RENTAL CONDITIONS

  1. General

The landlord cannot be held responsible for any disruption, modification or inability to stay of the customer, if this is the result of unforeseen or insurmountable events beyond its control. The landlord cannot be held responsible for inconveniences caused by the work of third parties, such as the municipality, province, etc. The landlord rejects any responsibility for loss, theft or damage to luggage, personal belongings or vehicles, as well as for costs resulting from not reaching the holiday home on time due to delay.

IMPORTANT HOUSE RULES:

– Pets are not allowed in the house

– It is not allowed to smoke in the house

– It is not allowed to organize parties

– In regard of the neighbours: silence between 23.00 – 07.00h

– Do not sit with wet (swim) clothes on wooden chairs in the kitchen, dining room or on the sofas in the living room or playroom as the salt water will damage the wood, fabric or leather

– No glass may be used around the pool, only plastic glasses, plates and bowls are allowed. Kitchen utensils (pans, plates, cutlery etc) are not allowed in the pool area of the garden. If glass is placed in the pool, then in accordance with legal obligation, the pool must be completely drained and cleaned. These costs are for tenant

– Please use the airconditioning in the evening and at night

– Due to the location of the house, it is possible that a sudden wind can arise. It is important that the sun umbrellas are closed every time you leave so that no damage can occur.

A reservation is valid from the moment the required deposit has been received. 

Paying this means that the tenant has taken note of and agrees to the general rental conditions mentioned here and the full description of the property he has rented. 

The prices of Casa Balau are calculated in euros and are per house per week or another period, if so stated in the rental contract. Costs of meals, drinks, etc. are never included in the price. 

The rental rate includes VAT, tourist tax, electricity, gas, water, use of air conditioning, bedlinen, towels, tea towels, WIFI, pool and garden maintenance. Guests receive two sets of towels and 1 pool towel per week. For rentals of 2 or more weeks, linen and towels will be replaced once. Washing machine, drying racks and dryer, iron and ironing board can be used.

The rental rate does not include the final cleaning.

For each reservation 20% of the rent must be paid in advance. This deposit must be credited to the landlord’s bank account within 10 working days following booking confirmation.

The remaining 80% must be received by the landlord no later than 60 days before the start of your stay. If this has not taken place, the tenant will receive an email with the request to pay the remainder within 5 days. After this, the landlord has the right to pursue legal action to obtain the remaining 80% of the rent as well has the right to offer the holiday home for rent on the market again. 

If the reservation takes place less than 60 days before the start of the rental period, the rent must be paid in full immediately. 

Any cancellation must be notified to the landlord in writing by email. 

The landlord will charge the following amounts, depending on the date of cancellation by the tenant: 

  1. In case of cancellation 61 days or prior to arrival the amount paid will be refunded.
    1. In case of cancellation 60 days or less to arrival date the full rent is due and no refund is due

The tenant is strongly encouraged to take out cancellation insurance. 

If the tenant does not use the holiday home or leaves it before the end of the rental period, no refund will be made (except for the rental deposit). 

If due to unforeseen circumstances the landlord has to cancel a rental agreement, the tenant will be informed immediately, and refunds will be made via the landlord’s account. 

No complaint will be processed if it is not reported by telephone within 48 hours of taking possession of the holiday home and is followed by a registered letter. The same rule applies if something serious occurs during the stay in the holiday home. 

If the tenant refuses to take possession of the holiday home because the condition of the property does not correspond to what he can reasonably expect from it, he must contact the landlord immediately. If it is not possible to reach an agreement, he must have the complaint verified by an expert, a bailiff or a notary, in order to obtain an objective opinion. 

The present contract has been drawn up and must be interpreted in accordance with Dutch law. All disputes that may arise from this contract shall be subject to the exclusive jurisdiction of the Dutch subdistrict court. 

All information provided by the landlord regarding the layout, furniture or facilities is provided in good faith.

If there is a change between the time of reservation and the start of the rental period, the landlord will inform the tenant about this, but the landlord cannot be held responsible for this. 

If, in spite of everything, the information regarding the holiday home, the layout, the furniture, the maximum number of occupants or the relevant facilities turns out to be incorrect, the tenant must immediately inform the landlord so that he can rectify the situation. 

All information regarding tourism and sports activities has been provided by third parties and is not the responsibility of the landlord. 

Arrival at a holiday home normally takes place between 16:00 and 18:00, unless otherwise agreed. Latest 3 days before check-in, you are requested to contact the property manager by WhatsApp and inform him on your estimated time of arrival. If your estimated time of arrival changes due to unforeseen circumstances, you are requested to contact the property manager by WhatsApp or telephone. If this procedure is not followed, the landlord cannot be held responsible for not being able to take possession of the property at the time the tenant arrives on site. 

The holiday home must be vacated no later than 10:00 am on the day of departure.

No more than a total of 14 people (adults (persons aged 16 and over) and children (0-15 years)) may stay in the holiday home, unless prior permission has been granted by the landlord.

The number of residents for a specific period is described in the rental contract. If this number is exceeded, the property manager can deny access to the holiday home to these extra people. If at a later time, without the knowledge of the property manager additional persons come to stay in the house, a claim of 25% of the rent per additional person will immediately arise, which, if necessary, will be deducted from the deposit. 

  1. Pets

It is not allowed to bring any pets into the holiday home.

  1. Liability and deposit

The owners are not responsible for accidents, injuries or illnesses that occur during a stay in or around the property. The homeowners are also not responsible for the loss of personal belongings or valuables. The use of the swimming pool and any inflatable pools is at your own risk.

The deposit, excluding the rental rate, is 500 euros and is due upon arrival in cash. The tenant is liable for damage to the rented property, including the damage to or loss of (part of) the inventory, caused during the rental period, unless the tenant can make a plausible case that the damage cannot be attributed to him, his family members or guests. 

The deposit will be refunded in cash at departure at the latest, after deduction of any compensation for any damages.

12. Cleaning and maintenance

A mandatory final cleaning is exclusive of the rental rate. The cost for the final cleaning is added to the rental rate and included in the final price shown when making a reservation.

The swimming pool (with salt water) is regularly checked and cleaned by the pool maintenance people. The gardener will do some work in the garden during the week where necessary.

Upon departure, the tenant must leave the house tidy.
